Terms of Service
§ 1 Scope
(1) These General Terms and Conditions (“GTC”) apply to all orders and contracts between La Muel Lingerie (“Seller”) and consumers or entrepreneurs (“Buyer”).
(2) The subject matter of the service is the delivery of goods from the seller’s online shop ( www.lamuel.de ), which the seller offers there and which are ordered by the buyer.
(3) Deliveries, services and offers are made exclusively on the basis of these General Terms and Conditions. The General Terms and Conditions also apply to companies for future business relationships unless they are expressly agreed again. The inclusion of general terms and conditions of a buyer that contradict these General Terms and Conditions is expressly rejected.
(4) The current General Terms and Conditions can be accessed at any time at www.lamuel.de/agb and are available for downloading and printing there.
§ 2 Conclusion of Contract
(1) The presentation of goods in the online shop and information about stock do not constitute a binding offer to conclude a purchase contract. By ordering online in the shop (confirming the "Pay now" or "Agree and pay" button), the buyer makes an offer to conclude a purchase contract.
(2) Online orders can be placed either by email or through the specially set up online shop.
(3) An order via email will be confirmed or rejected by the seller within 5 days.
(4) The contract is concluded in the online shop via an electronic ordering system in which the buyer can conclude the contract by clicking on a purchase button. However, the contract is only concluded once the creditworthiness has been checked and approved by the third-party payment service provider.
(5) When the offer is submitted via the seller's online order form, the contract text is saved by the seller and sent to the customer in text form (email) together with these general terms and conditions after the order has been sent. In addition, the contract text is archived by the seller.
(6) This confirmation of receipt does not constitute acceptance of the purchase offer. A contract is not concluded by the confirmation of receipt, but when the acceptance of the purchase offer is expressly declared or the goods are sent to you without prior declaration of acceptance.
(7) The buyer undertakes to carefully check his details and personal data. Any delays and other disruptions resulting from non-compliance are at the buyer's expense. The customer must in particular ensure that the email address he has provided for order processing is correct so that the contract can also be processed via this address.
(8) The seller reserves the right to unilaterally revoke the contract within five days. In such a case, he will send the buyer a rejection of the order.
(9) The range of goods offered in the online shop is aimed exclusively at buyers who are at least 18 years old.
§ 3 Prices and payment conditions
(1) Unless otherwise stated in the seller's product description, the prices indicated are total prices. Additional delivery and shipping costs are specified separately in the respective product description.
(2) Various payment options are offered. The payment option is determined by the buyer by selecting it in the seller's online shop.
(3) When paying using a payment method offered by PayPal, payment processing is carried out via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal terms of use or - if the customer does not have a PayPal account - subject to the conditions for payments without a PayPal account, which can be viewed at: ( https://www.paypal.com/de/webapps/mpp/ua/useragreement-full)
§ 4 Delivery and Shipping Conditions
(1) The delivery of goods takes place by shipping to the delivery address specified by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the seller's order processing is decisive.
(2) The place of success for returns is the seller’s place of business.
(3) The buyer is in default of acceptance if he does not collect the goods. If goods are returned to the seller by the transport service provider due to non-collection, the buyer shall bear the costs for the unsuccessful shipment.

§ 5 Retention of Title
(1) If the Seller makes advance payments, he reserves title to the delivered goods until the purchase price owed has been paid in full.
(2) For entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), the following shall additionally apply:
Ownership of the goods is reserved until all claims from the current business relationship have been settled in full. Before ownership of the reserved goods has been transferred, pledging or transferring ownership as security is not permitted. The goods may be resold in the ordinary course of business. In this case, you assign in advance all claims in the amount of the invoice amount arising from the resale to the seller. The assignment is accepted by the seller, but you remain authorized to collect the claims. If you do not properly meet your payment obligations, the right to collect the claims yourself is reserved.
The seller undertakes to release the securities to which he is entitled upon request to the extent that the realisable value of our securities exceeds the claims to be secured by more than 10%. The selection of the securities to be released is our responsibility.
§ 6 Warranty
(1) If the purchased item is defective, the provisions of the statutory warranty for defects apply, with the modification that the buyer's liability is limited to gross negligence. Sentence 1 does not apply, however, to personal injury or damage to health.
(2) The Buyer is obliged to complain about delivered goods with obvious transport damage directly to the deliverer and to inform the Seller thereof.
§ 7 Right of Withdrawal
(1) You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.
(2) To exercise your right of withdrawal, you must inform us (your name, address and, if available, your telephone number, fax number and email address) by means of a clear statement (e.g. a letter sent by post, fax or email to contact @lamuel.com ) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, but this is not mandatory. If you make use of this option, we will immediately send you a confirmation of receipt of such a withdrawal (e.g. by email).
(3) To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
(4) The items must be returned in their original condition, with all labels attached. The return of washed, damaged or altered items, or items that La Muel Lingerie assumes have been worn, is excluded. Briefs must be tried on over your own underwear. The self-adhesive protective labels must be left intact and unchanged.

§ 8 Consequences of revocation
(1) If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
(2) You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.
(3) You shall bear the direct costs of returning the goods.
(4) If the returned goods do not correspond to those delivered, we will charge the full purchase price.
§ 9 Miscellaneous
(1) All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany, excluding the laws governing the international sale of movable goods. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
(2) Should a clause or part of a clause be invalid, the validity of the contract shall remain unaffected.

Payment with PayPal
During the payment process, you will be redirected to the PayPal website where you can log in to PayPal and complete the payment. Once the payment has been made, click on the button that takes you back to the La Muel Lingerie online shop.
Attention: Please note that your PayPal account must have sufficient funds for the transaction to be completed successfully.
You will receive a confirmation email from PayPal when the money is credited to our account, as well as a second confirmation from us about the successful payment.

When paying by credit card, please provide the card number, expiration date and the three-digit security code, which is located on the back of the card to the right of the signature field. To avoid delays in checking your order details, please ensure that your details are spelled correctly. When you submit your order, the invoice amount is authorized on your credit card account. The actual charge is only made when the goods are dispatched.
